1. Who We Are

Quality Building Services (Midlands) Ltd ("we", "us", "our") is a professional building and home improvement company based in Upper Landywood, serving homeowners across Staffordshire. In these terms, "you" and "your" refers to the customer receiving our services.

2. Our Services

We provide building and construction services as described on our website at qualitybuildingservicesltd.com, including but not limited to:

  • Home extensions, including single-storey, rear, kitchen, and utility extensions
  • Loft conversions and garage conversions
  • New builds
  • General building, construction, and home improvement work

Full details of each service are available on our website. We reserve the right to update or adjust our services at any time. Where a change materially affects a booked project, we will notify you in advance.

3. Quotes and Pricing

3.1 We provide free, no-obligation quotations following a consultation or site visit. Quotes are based on the information available, the specification discussed, and the condition of the property at the time of assessment. Quotes are valid for 30 days from the date of issue unless otherwise stated.

3.2 We do not publish fixed prices on our website, as pricing depends on the size, design, specification, and access requirements of each project. Your written quote will clearly set out the work included and its cost.

3.3 Variations: If you request changes to the agreed work, or if the scope changes because of unforeseen conditions (for example, hidden structural issues, poor ground conditions, concealed services, asbestos, or requirements raised by building control), we will provide a written variation setting out the extra cost and any impact on timescales before proceeding. Variations are chargeable in addition to the original quote.

3.4 Provisional sums, where included in a quote, are estimates only and will be adjusted to reflect the actual cost once known.

3.5 VAT: Our prices will clearly state whether VAT is applicable. Where VAT is charged, it will be shown separately on your invoice.

4. Booking and Confirmation

4.1 A booking is confirmed when you have accepted our written quote (including by email) and we have confirmed a start date in writing.

4.2 By confirming a booking, you are agreeing to these terms and conditions in full.

4.3 Start and completion dates are estimates. We will always aim to keep to the agreed programme, but timescales may be affected by factors outside our control, including weather, material supply delays, planning or building control requirements, and unforeseen site conditions. We will keep you informed of any material changes to the programme.

5. Planning Permission and Building Regulations

5.1 Unless expressly agreed otherwise in writing, you are responsible for obtaining any planning permission, building regulations approval, and any other consents required for the project, and for any associated fees. We are happy to advise and assist with this where agreed.

5.2 Where building regulations approval is required, you agree to allow building control inspectors reasonable access to the site, and we will carry out the work in accordance with the approved plans and applicable regulations.

5.3 You are responsible for any notices or agreements required under the Party Wall etc. Act 1996 where work affects a neighbouring property, unless otherwise agreed in writing.

5.4 Where drawings or structural calculations are supplied by you or your architect or engineer, we will build to those specifications. We are not responsible for errors or omissions in designs we did not prepare.

6. Access to Your Property

6.1 You must ensure that we have clear, safe, and reasonable access to the work area throughout the project, including access for deliveries, skips, and equipment, and the use of water and electricity on site where required.

6.2 You must ensure that pets and children are kept away from the work area, and that all household members understand that the site is a working construction area.

6.3 You must remove or protect valuable or fragile items near the work area. While we take reasonable care to protect your property, we cannot be responsible for items left in the work area.

6.4 If we are unable to access the property on an agreed date for reasons within your control, we reserve the right to charge for wasted time and costs, and the programme may be extended accordingly.

7. Nature of Building Work

7.1 Building work, particularly on existing properties, can reveal issues that are not visible until work begins — for example, defective foundations, concealed damp, hazardous materials, or non-compliant previous work. Where such issues are discovered, we will inform you as soon as possible and discuss how to proceed, including any cost implications under Section 3.3.

7.2 Some disruption, noise, dust, and inconvenience is inevitable during building work. We will take reasonable steps to keep this to a minimum and to leave the site tidy at the end of each working day.

7.3 Minor cracking and movement in new plaster, brickwork, and finishes is a normal part of new construction drying out and settling, and does not on its own indicate defective workmanship.

7.4 We guarantee that all work will be carried out with reasonable skill and care, using appropriate materials, and in line with good trade practice and applicable regulations.

8. Payment Terms

8.1 Payment terms will be set out in your written quote. For larger projects, payment is normally made in stages — for example, a deposit on booking, stage payments at agreed milestones, and a final payment on completion.

8.2 Unless otherwise stated in your quote, invoices are payable within 7 days of the invoice date. Final payment is due on practical completion of the work.

8.3 We accept payment by bank transfer, debit card, or such other methods as may be agreed. Payment details will be shown on your invoice.

8.4 If payment is not received by the due date, we reserve the right to:

  • Suspend work on the project until the outstanding balance is cleared
  • Charge statutory interest on overdue amounts under the Late Payment of Commercial Debts (Interest) Act 1998
  • Refer the debt to a third-party collections service where necessary

8.5 Ownership of all materials and goods supplied remains with Quality Building Services (Midlands) Ltd until payment has been received in full.

9. Cancellation and Changes

9.1 Consumer cancellation rights: If you book our services as a consumer (i.e. not for business purposes) and the contract is made away from our premises, such as at your home, you have the right to cancel within 14 days of confirming your booking under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, without giving any reason. If you have asked us to begin work within that 14-day period and then cancel, you will be charged for any work already carried out and materials ordered. To exercise this right, please contact us at [email protected].

9.2 Cancelling after the cancellation period: If you cancel a confirmed project after the 14-day period, you will be responsible for the cost of work already carried out, materials ordered or supplied (including any non-returnable or made-to-order items), and any reasonable costs we have incurred in preparing for the project.

9.3 Our right to cancel or postpone: We reserve the right to postpone work due to circumstances outside our control, including severe weather, safety concerns, or supply issues. We will contact you to rearrange at the earliest opportunity.

10. Guarantee and Defects

10.1 We will rectify, at no additional charge, any defects in our workmanship that are reported to us in writing within 12 months of practical completion, provided the defect is not the result of fair wear and tear, misuse, lack of maintenance, alterations by others, or events outside our control.

10.2 Manufacturers' warranties on materials, products, and appliances remain the responsibility of the manufacturer. We will pass these to you on completion where we have them.

10.3 This section does not affect your statutory rights as a consumer.

11. Complaints and Remedies

11.1 We take pride in the quality of our work. If you are unhappy with any aspect of our service, please contact us as soon as possible so we can address the issue:

Email: [email protected]
Phone: 07976 640454

11.2 Where a complaint relates to the quality of work carried out, we ask that you notify us promptly, and in any event within 14 days of discovering the issue, so that we can inspect and assess it. We may need to revisit the property before we can determine an appropriate remedy.

11.3 Where we agree that work has not been carried out to a satisfactory standard, we will offer to put it right at no additional charge within a reasonable time. We will not be responsible for remedial work carried out by a third party without our prior agreement.

12. Our Liability and Insurance

12.1 We do not seek to exclude liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded by law.

12.2 Subject to clause 12.1, our total liability to you in connection with any project shall not exceed the total contract price paid or payable by you for that project.

12.3 We are not liable for any indirect or consequential losses arising from the provision of our services, including but not limited to loss of use of your property, loss of rental income, or alternative accommodation costs.

12.4 We are fully insured, and carry public liability insurance for all work carried out. Details are available on request.

12.5 You should notify your buildings insurer of the work before it starts, as building work may affect your cover.

13. Your Responsibilities

To allow us to deliver the best possible results, you agree to:

  • Provide accurate information about your property and requirements, including the location of any known hidden services
  • Obtain any required planning permission, consents, and approvals, unless otherwise agreed in writing
  • Ensure we have safe and unobstructed access to the work area
  • Make timely decisions on materials, finishes, and fittings so that the programme is not delayed
  • Notify us promptly of any concerns during or after the project
  • Pay all invoices by the due date

14. Data Protection

We collect and process your personal data in accordance with our Privacy Policy, which is available at qualitybuildingservicesltd.com/privacy-policy. By booking our services, you confirm that you have read and understood our Privacy Policy.

15. Governing Law

These terms and conditions are governed by the law of England and Wales. Any disputes arising from them will be subject to the exclusive jurisdiction of the courts of England and Wales.

Nothing in these terms affects your statutory rights as a consumer under UK law.

16. Changes to These Terms

We may update these terms and conditions from time to time. The current version will always be published on our website. For any ongoing project, any material changes will be communicated to you in writing before they take effect. Your continued use of our services after that point constitutes acceptance of the updated terms.
